Container supplied by the shipper

Amounted to a fault for exempting maritime transport the poor state of the container supplied by the shipper or the failure of any of its equipment. 

This statement does not, however, absolute in scope: the Court of Appeal of Aix-en-Provence has estimated that the carrier could not rely on the bad state (partial absence of sealing rubber at the door and visible holes on the ceiling) of a container rented by the sender.


Required to verify this "box", armament would not have issued a clean bill of lading reservations.This, coupled with the fact that it was found that the damage to the goods occurred during the trip (the presence of sea water inside the container), leads his conviction.
